Democratic Alliance files a case to remove Dr Hlophe from the JSC

Democratic Alliance takes action to remove Dr Johny Hlophe from the Judicial Services Commission(JSC). Hlophe was appointed as the Judge Whip of the MK party in the Parliament. Democratic Alliance has approached the Western Cape High Court regarding actions of removing Hlophe from the Judicial Services Commission.


The DA argues that Hlophe is not fit and proper person to be the Judge because he was impeached from office and should not serve on the commission that selects and should not serve on the commission that selects the future Judges.


In a statement which was issued by the Democratic Alliance Chairperson Federal Council Hellen Zillie, argues that as they accept that it is the prerogative of political parties to nominate person to serve on the JSC , It does not follow that former that a former Judge who was impeached for gross misconduct , can be designated by Parliament to serve on the body that found him guilty of the misconduct.


Artcic Alliance and Afriforum also filed the case to remove Dr Johny Hlophe from the Judicial Service Commission. In the interview earlier today with News Room Africa, Zillie said, they launched the case first Artic and Afri Forum are the ones that should have joined them first, she also said they didn't make any statements when they did launched the case first and it is not a competition.

Zillie explains that the courts has two parts in their case of removing Hlophe from the Judicial Services, '' Our case is in two parts so the fisrt part is to interdict Dr Hlophe from taking up his seats at the Judicial Services , Commission so that he cannot participate in the appointment process of a new Judges Services Commision , including his own one to full his own vacant position of the Judge at the President of the Wersten Cape, she said.


Zille said the second part of the case is to get the court judgement that the National Assemblt when they designed John Hlophe to be political representative on the Judicial Services Commision and we say that the Parliment ER because it so rational and undermines the indepency and integrity of the Judiciary to have a situation where a former judge who was impeached.


The Statement which was issued by the Dempcratic Federal Council Hellen Zillie , conclude that , This designation of Dr Hlophe presents a clear conflict of interest and undermines the independence of South Africa’s Judiciary. The National Assembly is obligated to protect and uphold the Judiciary’s independence, integrity, and dignity, a responsibility the DA takes seriously.
